1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and iSearch Digital (“we,” “us” or “our”), concerning your access to and use of our website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.

If you do not agree with all of these terms, you are explicitly prohibited from using our site and services, and you must discontinue use immediately.

Our primary services include Web Design, Local Search Engine Optimization (SEO), Facebook Ads campaigns, and Social Media Management. When you sign up for a project or monthly service plan:

• Scope of Work: Specific deliverables, timelines, and payment milestones will be outlined in a separate Service Agreement or Proposal signed by both parties.
• Performance Disclaimer: While we utilize industry-leading SEO and marketing practices to improve your online visibility, search engine algorithms (e.g., Google) change constantly. We cannot guarantee specific page 1 organic rankings or exact conversion volumes, but we promise to work diligently to drive maximum calls and leads.
• Client Responsibilities: You agree to provide necessary access (e.g., website login, Google Business Profile admin access) and timely responses. Delays in asset provision may result in delayed project schedules.

4. Billing, Cancellations, and Refunds

• Payments: All fees are payable in USD. One-time services (like web design setups) require a deposit as outlined in your proposal. Retainer-based marketing services are billed monthly in advance.
• Cancellation Policy: Monthly retainer agreements require a 30-day written cancellation notice unless otherwise agreed in your proposal.
• Refunds: Due to the digital nature of search engine optimization, ad campaigns, and custom design hours worked, payments are non-refundable once work has commenced.

5. Limitation of Liability

In no event will iSearch Digital, our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our marketing services, even if we have been advised of the possibility of such damages.

6. Governing Law

These Terms and Conditions and your use of the Site and Services are governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict of law principles. Any legal action arising from these terms shall be filed in the state or federal courts located in New Jersey.
